By accessing or using the website at vistaasphaltpaving.com (the "Site"), or by requesting, scheduling, or receiving services from Vista Asphalt Paving ("Company," "we," "us," or "our"), you agree to these Terms and Conditions in full. If you do not agree to these terms, please do not use the Site or request our services.
Vista Asphalt Paving provides asphalt paving, sealcoating, repair, and related services to residential and commercial customers in Vista, CA and surrounding North San Diego County communities. Services are performed by appointment only. We do not guarantee the availability of any specific service on any specific date until a written agreement or confirmation has been issued.
All estimates are provided in writing after an on-site assessment of the project. Verbal quotes are not binding. Written estimates are valid for 30 days from the date of issuance unless otherwise stated.
Final pricing may differ from an initial estimate if site conditions discovered during the work differ materially from those observed during the assessment - for example, if the base beneath an existing surface requires more repair than visible on inspection. We will notify you of any material change before proceeding with additional work.
Prices are subject to change due to fluctuations in material costs. We will honor a written estimate for its stated validity period.
Scheduled jobs may be postponed by either party due to weather conditions, equipment failure, or other circumstances beyond reasonable control. We will contact you as early as possible if we need to reschedule and will offer the next available appointment.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Cancellations made with less than 24 hours notice may result in a scheduling or mobilization fee, which will be communicated to you at the time of booking.
We reserve the right to decline or cancel a job if site conditions present safety hazards or are materially different from those described at the time of estimate.
Payment terms are specified in the written estimate or invoice. For residential jobs, payment is typically due upon completion of the work. For larger commercial projects, we may require a deposit before work begins, with the balance due on completion or according to a milestone schedule stated in the agreement.
Accepted payment methods will be stated on your invoice. Invoices not paid within 30 days of the due date may be subject to a late fee. We reserve the right to suspend or terminate services for accounts with outstanding unpaid balances.
In the event of non-payment, we reserve the right to pursue collection through lawful means, including the filing of a mechanics lien in accordance with California law.

We are not liable for damage caused by your failure to meet these responsibilities.
We stand behind our work. If a defect in our workmanship is identified within a reasonable time after job completion, we will assess the issue and correct it at no additional cost, provided the defect is not caused by conditions outside our control.

Specific warranty terms for your job will be stated in your written estimate or agreement. Where no specific term is stated, warranty coverage is limited to one year from the date of project completion.
To the maximum extent permitted by applicable law, Vista Asphalt Paving and its employees, subcontractors, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or the Site, including but not limited to lost profits, property damage beyond the scope of the job, or damages resulting from delays in project completion.
Our total liability for any claim arising from services provided under these terms is limited to the amount you paid us for the specific job giving rise to the claim.
The Site and its content are provided on an "as is" basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the Site is for general purposes only and does not constitute a binding quote or guarantee of service availability.
We prefer to resolve any dispute informally. If you have a concern about our work or billing, please contact us directly at sales@vistaasphaltpaving.com or (442) 216-7772. We will make a good-faith effort to address the issue promptly.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing any other legal remedy. Any legal action arising from these terms or from services provided by Vista Asphalt Paving will be brought in a court of competent jurisdiction in San Diego County, California.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or related to these terms are subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
We may update these Terms and Conditions from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Site or our services after any updates constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
